Membership Agreement

(Hereinafter referred to as Part A)
Client: ___________________________ (Hereinafter
referred to as Part B)
Part A is one of the top-starred homemaking service providers in shanghai,
focused on providing the aristocratic housekeeping service. Part B
will become _____ type VIP member of Part A upon the date of Party
B's paying membership fee to Party A. The membership agreement will
be terminated upon the signing of the termination agreement.
Types of membership and the member fee:
Intelligent Service VIP 118RMB, Housework Service VIP 158RMB
General Type VIP (Both of the above) 198RMB.
Ⅰ．Rights for members
1. Part A will assign a dedicated home consultant to prepare a separate
family full
gamut proposal for Party B after learning his/her demands,
including the item,
time, place, expenditure and so on of the required services.
2. Part A's home consultant will arrange
for Party B the housekeeper interviews and
corresponding after-sale services based on the family full gamut
proposal.
3. Part A's home consultant shall adjust
family full gamut proposal in response to
the reasonable requirements of Part B at times and re-educate and
re-train the
housekeepers in order to meet Part B's occasional requirements
as much as
possible.
4. Part A shall provide satisfying housekeepers
to Part B according to different
types of membership within the membership term. If it is due to
Part A's fault
that Part B is not satisfied and ask for replacement, Part A should
replace the
housekeepers for Part B till to his/her satisfaction. However,
if it is not due
to Part A's fault, Part A will arrange at most three replacements
for Part B.
5. Upon the signing of the agreement
and the family full gamut proposal between
both parties, Part B as the member starts to receive the services
and enjoy the
membership price for it.
6. Membership fee is collected upon
the signing of the agreement, and Part A will
charge Part B the estimated service fee within 7 days upon the
commencement of
the housekeeper's work. (for details please see the family full
gamut proposal)
7. Part A should be responsible for
the housekeeper's wages and welfare. It is not
necessary for Part B to arrange any payment related to the wages
and welfare.
8. If the agreement is to be terminated
in discretion of Part A, Part A should
immediately refund the balance of the estimated service fee to
Part B within 3
days and the agreement is regarded to be terminated.
9. If Part B need to quit the membership,
Party B shall notify Part A of it 3 days
in advance. A balance or supplemental payment of the estimated
service fee
shall be refunded or arranged based on the actual service fee.
And the
agreement is regarded as terminated.
Ⅱ．Responsibilities for members
1. Part B shall fill in the register form honestly. In case of change
of Party B's
resident address, telephone number or other important information,
Part B shall
notify Part A of these changes in time. If it is caused by Part
B's negligence
or delay of notification that Part A fails to perform his obligation
under this
agreement, Part B shall incur the consequences or liability thereof.
2. Part B shall respect the body, reputation
and other legitimate rights of the
housekeeper assigned by Party A. Party B shall incur all liabilities
for any
damage to the rights described above of Party A's housekeeper due
to Party B's
fault.
3. If Part B initiates unilateral termination
of the agreement after signing of the
agreement, Part A can regard this agreement as terminated and shall
charge Part
B the membership fee and actual real service fee.
4. It shall be regarded as breach of
the agreement if Part B retains the employment
of Party A's assigned before housekeeper after the termination
of the agreement
with Party A. As a result of that, Party A can activate an automatic
dismissal
of the housekeeper in question. Any dispute arising between Party
B and the
housekeeper (including the economic, civil and criminal dispute)
thereafter shall
has nothing to do with Party A. Also, upon the discovery of the
fact described
above, Part A will claim against Party B for a breach penalty of
RMB 5,000 as
well as the corresponding legal cost thereof.
Ⅲ．The family full gamut proposal
- appendix of the membership agreement signed by
both parties is an indivisible part of the agreement and has the
equal legal
effect.
Ⅳ．This agreement is in duplicate
and takes effect upon the date of signing. Each
party keeps one copy in same legal effect.
