II、Supplemental clauses:
1. Service method: It can be negotiated between both parties if
Part A or
Party B need to temporarily adjust the fixed service time.
2. Service time: It is calculated
on actual service hours. In case of less
than 30 minutes, it shall be calculated as half an hour; In case
of more
than half an hour and less than an hour, it shall be calculated
as one
hour´. and the like. Part B is required to sign the Monthly/Service
Working Hours Confirmation Form after each service or at
the end of each
month.
3. Retention Fee:
i. If the Party A's housekeeper is to pause the service in request
of Party
B for more than 1 - 2 working days within one month, the notification
shall be sent to the housekeeper 24 hours in advance. If Part
B fails to
notify the housekeeper of the service suspension and that result
in
housekeeper's idleness at Party B's home, the service fee of
that day shall
be paid as usual. If prompt notification can be sent in time,
the service
fee of that day can be exempted. In case of service suspension
duration
exceeding two days, if Party B intend to retain the original
housekeeper,
he has to pay 50% of the service fee for the entire service suspension
duration (including the two days described above). If there is
no need for
retention of the original housekeeper, no any additional fee
shall be paid
and Party B will arrange new housekeeper for service.
III、Payment term:
1. Part A will collect membership fee based on membership types
after Party B's
signing of the agreement. And Party A will collect from Party
B the estimated
service fee within 7 days upon the date of service commencement.
The membership
fee is charged in accordance with the membership types and the
estimated service
fee is charge on monthly base. The estimated service fee: RMB_________.
In case
of adjusted service item and time, it is subject to the adjusted
service fee in
estimation.
2. The time for each service fee collection
is within the first 10 days (10th date)
of each month. The total amount of the collection shall be the
actual service
fee in last natural month (calculated on the service working
hours confirmation
form). Meanwhile, the estimated service fee of last month will
be transferred
automatically to the one of this month, and no additional estimated
service fee
is required to be paid. If Part B fails to arrange the payment
in time, he shall
pay the overdue fine at 0.5% of the service fee per day (those
arising from Part
A's fault excluded). In case of outstanding payment of the actual
service fee
for more than 14 days, Part B shall be regarded to breach the
agreement and Part
A can deduct the actual service fee from estimated service fee
and cancel the
membership of Part B.
3. Party B can transfer money to Party A's company account or the
account of Party
A's manager (for details please see the account confirmation
letter), or Party A
can also sent the courier to collect the money (the courier fee
shall be born by
Party B). Party A shall provide formal invoice to Party B after
the collection
of money. Party B shall not directly pay Party A's housekeeper
any service fee
in any way, otherwise Party A will not admit the collection.
In case of service
time less than a month, the calculation method of the service
fee is described
in the account confirmation letter.
IV、Holidays of housekeepers:
Part B agrees that Party A's housekeeper shall have
at least one day off each week. If Party B intends not to allow
the holiday of
Party A's housekeeper, Party B shall pay the housekeeper overtime
wage. The
overtime wage is double of that of usual day. Party A's housekeeper
shall enjoy
the paid holiday in state legal holidays (Including Spring Festival
of 3 days,
National Day of 3 days, May Day of 3 days, New Year's day of 1
day). If
Party A's housekeeper is required to provide service the days
described above,
a 3-times of wage payment shall be paid.
V、any change of the proposal
is subject to the change notification for family
full gamut proposal signed by both parties.
VII、This agreement is in duplicate
and takes effect upon the date of signing.
Each party keeps one copy in same legal effect.
